In a rather unusual case, Benitaxell council sacked its town clerk for refusing to pay council bills authorized by the local government council.

Announced on Monday, May 30, the dismissal of Jesús Castro came when he was also accused of obstructing the functioning of municipal services and in particular its audit function.

Castro was suspended in April 2021 after a disciplinary action found him guilty of obstructing Council operations and refusing to obey orders issued by the Local Government Council.

The events date back to October 28, 2020, the day the local government council was held which included the approval of a list of bills. As there was no record of objection to the invoices, they were approved for payment.

The next day, Castro said he had no intention of making the payments ignoring a payment order issued by the mayor’s office. Finally, on November 4, he prepared a document entitled “Reparos Report”, in which he expressed his disagreement with the approval of these invoices.

Local treasury law requires that objections be made before bills are approved for payment, however, Castro did not do so until seven days later in the process breaking the law.

He was suspended for six months for having ignored an order or instruction from his superior and dismissed for: “having constituted a permanent obstacle to the normal functioning of municipal public services, drawn up reports (in particular complaints in his control function ) outside the ordinary deadlines of good administration. practice, and without justifying or demonstrating the causes of the said delays”.

In sacking the town clerk for refusing to pay council bills, Benitaxell council said they regretted having to make the decision but had no choice but to let him go.
